The Crucial Distinction: Moving the Bike vs. Re-Registering It
If you are relocating from Gurgaon to Bangalore, Delhi to Pune, or Jaipur to Mumbai, you will inevitably hear conflicting advice: some say you must obtain an RTO NOC before shipping, while others claim an NOC isn't necessary. Both are partially right—depending on the context.
Here is the clear legal reality:
- Phase 1: Physical Transit: To physically transport your motorcycle, scooty, or sports bike on a freight container or train, an NOC is NOT required. Moving companies and Indian Railways only require ownership proofs (RC copy, active Insurance, and PUC).
- Phase 2: Riding in the Destination State: Under Section 47 of the Motor Vehicles Act, 1988, you can legally ride an out-of-state vehicle for up to 11 months without changing registration. If you plan to stay permanently (beyond 1 year), an NOC (Form 28) from your origin RTO is legally required to re-register the bike and pay local state road tax.
When Do You Need an NOC vs When Can You Skip It?
Temporary Relocation (< 11 Months)
If you are shifting for college (DU, UPES, MANIT, IIT), a short-term corporate project, or internship under 1 year:
- Keep original RC, Insurance, and PUC in DigiLocker or mParivahan.
- Keep a copy of your First Choice Movers Bilty/Lorry Receipt as proof of arrival date.
- Ride freely without local state re-registration.
Permanent Relocation (> 12 Months)
If you have bought a home, permanently relocated your family, or plan to sell the bike in the new state:
- Apply for RTO Form 28 (NOC) via Parivahan Sewa online portal.
- Submit NOC to the destination RTO within 6 months.
- Pay pro-rata state road tax and obtain new state registration plates.
Step-by-Step Procedure to Apply for Bike NOC Online (Parivahan)
- Visit the official Parivahan Sewa Portal.
- Navigate to Online Services → Vehicle Related Services and select your home state and registered RTO office.
- Click on "Application for No Objection Certificate (NOC)" and input your Vehicle Registration Number and the last 5 digits of your chassis number.
- Verify pending traffic e-challans. All outstanding challans must be cleared before Form 28 can be processed.
- Upload your address proof in the new city and pay the statutory fee (typically ₹100).
- Print Form 28 in triplicate (3 copies) with the engine/chassis pencil stencil imprint and submit to your RTO desk for final stamping.
